These terms and conditions of use represent the Agreement between yourself and us. Please read these Terms & Conditions before using the site.
AGE RESTRICTION
By using the website to consume content or buy our products, you confirm that you are at least 18 years old, and are consenting to these terms and conditions and to our privacy policy.
OUR SERVICES
We provide gift hampers and gift sending services. All products are GST exclusive. Shipping is not included in our prices. Read the SHIPPING POLICY.
We offer free local delivery in Griffith NSW and surrounding suburbs within a 25km radius or by consented arrangement.

COPYRIGHT
We shall own all right, title and interest, including all related Intellectual Property Rights, in and to the content and the service and any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by you or any other party relating to our services and products.
Our Agreement is not a sale and does not convey to you any rights of ownership in or related to our services, any of our products, or the Intellectual Property Rights owned by Hancock Hampers.
The product names associated with our services are trademarks of Hancock Hampers.
ORDERING
By completing and submitting an electronic order form, you are making an offer to purchase products or services you want for your customized package, which, if accepted by us, will result in a binding contract.
Please note that products will not be sent or the services you want for your package will not be done, until we have notice of your payment.
We will not be liable if there is a delay, and we will not accept your order if payment is not authorized.

We do not have to accept your order, and for example, we will not accept your order if:
i. We do not have the products in stock
ii. Your payment is not authorized
iii. There is an error on our website regarding the price or other details of the products
iv. You have cancelled your order

PRICING AND PAYMENT
Prices throughout the website are quoted in AUD dollars, and payment can only be accepted in AUD Dollars.
While we make every effort to ensure that the products shown on our website are currently available, we cannot guarantee that this will always be the case.
If products you have ordered are unavailable, you will be notified as soon as possible.
The price you pay is the price of the products at the time you place your order.
Your payment card will be debited for your order at the time the order is placed. By submitting an order for our products or services, you expressly agree not to request a ‘charge back’ of any fees or payments for said orders, and that no dispute with us will be raised with or adjudicated by the credit card company. Rather, you agree to contact us directly to resolve the issue or obtain a refund where applicable.
CHANGES TO TERMS & CONDITIONS
We reserve the right to change these Terms & Conditions. If this happens, we will notify you by posting the new Terms & Conditions online on the website.
If you do not wish to be governed by the revised Terms & Conditions for buying products online, you must not place any further orders.

GUARANTEE
We do NOT, in any way, offer any guarantee for the success of the products and services in our Website.
We don't guarantee that the prices we offer in the menu costing are relevant based on the fluctuating market prices.

TERMINATION OF AGREEMENTS AND REFUNDS POLICY
The parties have the right to terminate any Agreement that has been entered under these terms and conditions for any reason, including the ending of services that are already underway.
No refunds shall be offered, where products have already been sold, or a service is deemed to have begun and is, for all intents and purposes, underway.
Any monies that have been paid to us which constitute payment in respect of the provision of unused services or undelivered products shall be refunded.
PRIVACY POLICY
By using our services, you provide Hancock Hampers with your personal information, you consent to the collection, storage and use of your personal information to enable us to provide you with our products and service. Hancock Hampers collects personal information only for the purpose of conducting our business and providing our products and services.
Hancock Hampers does not sell or rent any personal Information to third parties ever.

EXCLUSION AND LIMITATIONS
The information on our web site is provided on an "as is" basis.
To the fullest extent permitted by law, we:
PROVIDE NO WARRANTY, EXPRESS OR IMPLIED, NOT EVEN A WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE INCLUDING IN RELATION TO ANY INACCURACIES OR OMISSIONS IN OUR WEBSITE AND/ OR ITS CONTENTS, INCLUDING OUR PRODUCTS AND SERVICES; and
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE, AND ANY OTHER PERSON OR ENTITY ASSOCIATED WITH OUR OPERATION, SHALL NOT BE HELD LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES ARISING OUT OR IN CONNECTION WITH YOUR USE OF OUR PRODUCTS AND SERVICES, OR ANY OTHER DAMAGES RELATED TO US OF ANY KIND WHATSOEVER
GENERAL TERMS
Entirety - These terms represent the entire Agreement between the Parties and supersede any previous written or oral agreement.
These terms may be modified at any time. Upon any modification, the updated version shall be posted in the App. If you continue to use the App after such an update, you shall be deemed to have accepted the changes.
Severability
The parties agree that if any portion of these terms is found to be void or unenforceable, it shall be struck from the record, and the remaining provisions will retain their full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.
Anti-Assignment
This Agreement is personal and cannot be transferred to any other person. However, we have the right to assign the rights and obligations at our discretion.
LIQOUR LICENSE
A liquor license is not required to sell alcohol that is included in the sale of flowers or food designed to be delivered as a genuine gift to a person, such as a gift basket or bouquet of flowers.
Alcohol included in the gift must be purchased from a retail liquor outlet.
Two litres is the maximum volume of alcohol permitted in each gift.
The gift must be packaged and presented in such a manner that it would be taken to be a gift.
The gift can only be delivered to another adult who is not the purchaser.
The gift cannot be delivered to a person at the location where the gift was purchased
Gifts must be delivered between the hours of 7am to 7pm.

DISPUTE RESOLUTION
If you have any concerns or disputes about our products or services, you agree first to try to resolve the dispute informally by contacting us. If that fails, the dispute will be settled through a mutually agreed course.
